Վիրտուալ ակտիվների ի հայտ գալուն զուգընթաց առաջացող ռիսկերին համարժեք արձագանքելու նպատակով Կենտրոնական բանկը մշտադիտարկում է վիրտուալ ակտիվների ոլորտի զարգացումները թե՛ Հայաստանում, և թե՛ աշխարհում: Այս մասին տեղեկանում ենք Կենտրոնական բանկի պաշտոնական հաղորդագրությունից:
2018 թվականին Կենտրոնական բանկը հանդես է եկել վիրտուալ ակտիվների վերաբերյալ հայտարարությամբ, որով հասարակությանը տեղեկացրել է վիրտուալ ակտիվներով կատարվող գործարքների բարձր ռիսկայնության և վտանգավորության մասին:
Վերջին տարիներին վիրտուալ ակտիվների շրջանառության ծավալների աճի պարագայում ակնհայտ են դարձել դրանց հետ կապված մի շարք խնդիրներ, այդ թվում՝
• վիրտուալ ակտիվներում անհատների ներդրումների աճը տեղի է ունենում վերջիններիս շահերի ոչ բավարար պաշտպանվածությամբ, միջոցների ոչ բարեխիղճ պահպանության գործընթացներով և տեղեկատվության, իրացվելիության և գնագոյացման անբավարար թափանցիկությամբ,
• վիրտուալ ակտիվների ոլորտը բնորոշվում է տարբեր կրիպտոհամակարգերի փոխկապվածության մեծ աստիճանով, մեկ կազմակերպությունում կամ խմբում կուտակված գործառույթների ուղղահայաց ինտեգրված խոցելի կառուցվածքներով, կառավարման ոչ պատշաճ համակարգերով, պարտավորությունների էական բարձր մակարդակով՝ պարունակելով ի թիվ այլոց շահերի բախումների և ֆինանսական կայունության ռիսկեր,
• վիրտուալ ակտիվներով կատարվող գործարքների անանունությունը և անդրսահմանային գործարքների ծավալները բարձրացնում են դրանց հետ կապված փողերի լվացման և ահաբեկչության ֆինանսավորման ռիսկերը,
• վիրտուալ ակտիվներով մատուցվող մի շարք ծառայություններ իրենց բովանդակությամբ նման են ավանդական ֆինանսական ծառայություններին, հետևաբար պետք է կարգավորվեն նույն օրենսդրությամբ, սակայն փաստացի գործող օրենսդրությունից դուրս են գործում, ինչն ավանդական ֆինանսական ծառայություններ մատուցողների համար ստեղծում է անհավասար մրցակցային պայմաններ:
Ստանդարտներ սահմանող միջազգային կազմակերպությունները (IOSCO, FSB, IMF, BIS, FATF) հստակ դիրքորոշում են հայտնել՝ կարևորելով բոլոր երկրների կողմից վիրտուալ ակտիվների միասնական և համապարփակ կարգավորման անհրաժեշտությունը՝ պայմանավորված վիրտուալ ակտիվների շուկայի չտեղայնացված (վիրտուալ) բնույթով և անդրսահմանային շրջանառությամբ։
Հաշվի առնելով վերոնշյալը, ինչպես նաև այս ոլորտի հետ կապված համաշխարհային զարգացումները, Կենտրոնական բանկը նախաձեռնել է վիրտուալ ակտիվների համապարփակ կարգավորման ու վերահսկողության արդյունավետ մոդելի մշակման և ներդրման միջոցառումներ, նշված է հաղորդագրության մեջ:
Արդյունավետ կարգավորման համար Կենտրոնական բանկը հիմք է ընդունելու «նույն գործունեություն, նույն ռիսկ, նույն կարգավորում» սկզբունքը, համաձայն որի՝ այն վիրտուալ ակտիվներով ծառայություններ մատուցողները, որոնք առաջարկում են ավանդական ֆինանսական գործունեությանը նմանատիպ ծառայություններ, պետք է կարգավորվեն նույն ձևով:
Կարգավորումը հնարավորություն է տալու համարժեք արձագանքել վիրտուալ ակտիվների ոլորտում առկա և հնարավոր ռիսկերին՝ միաժամանակ հստակ իրավական դաշտ ստեղծելով վիրտուալ ակտիվների ոլորտում նորարարությունների և տեխնոլոգիաների զարգացման համար:
